Tanzania Alternative Dispute Resolution
The consultancy to "Conducting an Analysis of Alternative Dispute Resolution in Tanzania and for Training of Trainers for Enchancement of Alternative Dispute Resolution to Judicial Officers in Tanzania" came about due to an acute shortage of trainers in Alternative Dispute Resolution (ADR). The need for ADR tainers become and continue to become increasingly crucial as the number of judges, magistrates and lawyers grows from year to year. Additionally, the ADR amendment to the Civil Procedure Code itself has come against some criticism form the legal community. The objectives of the consultancy are to:
- To provide the Judiciary, Ministry of Justice and Constitutional Affairs, and Tanganyika Law Society with an evaluation of the successes and failures of the ADR mechanism to date. This includes an analysis of existing legal frameworks and regulations that will enable identification of recommendations to improve the current applications, and legislative reforms where required.
- To thereafter provide recommendations of any legislative, procedural, administrative, or managerial improvements to the ADR mechanism set out in the Civil Procedure Code 1966;
- To develop a plan for sustaining long term ADR training in Tanzania;
- To design a comprehensive training programmeme for the training of ADR trainers;
- To draft a comprehensive training manual for ADR trainers and ADR trainees; and
- To conduct training of 50 trainers as selected by the Client.
